27My Husband Has 3 Children He Only Paid Child Support On For A Very Short Time. They Are All Grown, Married?
Filed in: Teen Advice by BakoBiscuit on 11-27-09They (3) are all grown. In old times, he would take the cash directly to his exwife. He covered medical expenses they incurred growing up. His ex-wife now holds this over his head if she wants him to do something. He paid for his eldest daughter first son to be born, which was a very complicated birth. We took the children in in their teens and the youngest, Child Protective Services gave to us because his mother was deemed unfit. At one point, he was even working for his exwife and she made out his checks and still did not withdraw the childsupport from the checks that she made out to him. As his new wife, I don’t want this debt hanging over my head. She had told him that she will not pursue this because he did pay child support for so many years, but when she gets mad it is a different story. We only have one child together and that is all that we will have. What kind of arrearages would a man making 6K per month have to pay per month? What can I do to fix all this?

He needs a lawyer ASAP.
YOU do nothing to fix it all. It’s not your problem, it’s between him and his ex wife. Hopefully he saved all his receipts and the dates that he took whichever of the kids in to his/your home. He should get an attorney, go to court (before they find him and take him to jail) and get everything straightened out. He may or may not owe her money, but this is something he can’t just bail on if the court records show that he didn’t pay.
If there was no child support ordered when those children were younger than she has no right to child support now. If she has any children under age 18 at home right now from him, then he may have to pay for that one, but it would only go from the date she tried to start up the support order. he wouldnt owe back support. Your husband is only responsible to a child until the age of 18.
So those kids are all over 18- the ex wife can just shut up and your husband should know his rights and consult an attorney if she decides to go through with the threats- she wont get a dime.
I would check and see if your husband owes any money for child support with the state, county, or whatever agency handles this in your area. IF…they say he owes nothing…back or otherwise…then his ex can do nothing. The kids are grown and this would all be ” after the fact”. The ex should have taken him to court when the kids were growing….but I think she didn’t because he was taking care of business. Where I’m from…they can’t ” go back ” to when the Mother says they broke up or whatever…they start……at the time she reports….if the kids are grown ?…What does she have to report ? Tell her to “buzz” off and quit making threats.

there is only one way to fix it… pay off the arrears; payments, one lump sum, neg a deal or what ever. the arrears does not go away.
she can not hold it over his head if its being paid or is paid off.
take it to court and get it going yourself. end the stress of it all.
I am not sure I understand your question. If there was not an exisiting child support order in place when the kids were minors then there is no arrerages owed. Its that simple. However, if there was an Order and he was behind in payments then he owes money. You can’t have someone hold something over your head unless you let them. Even if he does owe her money, you allow them to hold it over your head.

Is there a court order that states he HAD to pay child support? If so – then definitely contact a lawyer ASAP to get things resolved and dig out the receipts if you have them!!
Get an attorney! If you have receipts for any of these expenses, take those to the attorney.
